The state attorney general's office is pushing back against Jerry Sandusky's appellate attorney.
The Commonwealth says Karl Rominger cannot appeal a judge's order for him to disclose who he gave confidential information to related to the case.
The motion says that Rominger waived his right to appeal in a June hearing.
Rominger believes the court's order is unconstitutional and is appealing the issue before the state Superior Court.
Sandusky's jury trial judge, the Honorable John Cleland has approved the motion.
Rominger needs to explain specific reasons for why he's appealing within several weeks.
