McGee is facing attempted homicide and aggravated assault charges. The 45 year old pleaded not guilty to the charges. He is accused of shooting out a police cruiser window and then pointed his loaded shot gun at officers. Officer John Lucas opened fire hitting McGee in the stomach through an office window. The District Attorney said the shooting was justified and McGee had apparently video taped the shooting himself. Lucas testified at the hearing that he was a 36-year veteran with the police department serving as an officer. He is also a firearms instructor and served on the county SERT team as a sniper.
During Wednesday's hearing the 45 year old said he was self employed and battled depression. Since the shooting September 13, 2012 investigators learned McGee was headed to the police department to confront the officer who arrested him back in February, that officer just happened to leave 25 minutes before the shooting.
McGee will remain in the Cambria County Prison and will head to trial on aggravated assault, attempted homicide and other related charges.
