Man Convicted of Murder Given New Trial

A Hollidaysburg man convicted in a brutal 2004 murder will get a new trial.

On Wednesday, the State Superior Court announced that it will uphold the decision to give Paul Aaron Ross a new trial, made earlier this year.  Ross is serving a life sentence for the rape, torture and murder of Tina Miller of Hollidaysburg.  The 26-year-old Miller was found dead in Canoe Creek.  In May, a three judge panel ruled that Ross did not receive a fair trial, saying that Ross's attorney, Tom Dickey, didn't have enough time to prepare and some testimony against him should not have been admissable.

The decision to give him a new trial was appealed to a nine-judge panel, and upheld the ruling Wednesday in a split 5-4 vote.  Deputy District Attorney Wade Kagarise said Wednesday night that there is a good chance his office will appear to the State Supreme Court, and if they have to trial, they will again seek the death penalty.

Defense Attorney Tom Dickey said he's pleased and eager to retry the case.

If there is any doubt as to whether he got a fair trial it should be done over. Murder is a horrible crime, but if there's a chance the wrong man is in jail then that means the real murderer is still on the streets. I'd want to be sure about something like that........
