Jury Deliberating in Eichenlaub Trial

ALTOONA, BLAIR COUNTY - The jury has started their deliberations in the Duane Eichenlaub trial.

Eichenlaub is accused of aggravated assault for allegedly beating up Earl Eshelman in the bathroom at Pellegrine's Lounge in Altoona. He also faces conspiracy charges for allegedly trying to get other officers to keep his name out of the report.

The jury asked to see two pieces of evidence. The first was the diagram of the bathroom where the assaults allegedly happened. The judge granted that. They also asked to see the police report that Jack Kuhn filed that did not include Eichenlaub's name. That was never submitted as evidence so the judge only let them see parts of the report that were testified to in trial.

Later they asked for a clarification on Aggravated Assault. To find a person guilty they must believe he knowingly, intentionally, or recklessly caused serious bodily harm. The jury wanted to make sure one of those would suffice not all three.
